Bre-X class action

1. On November 24, 2004, the bankruptcy court judge in Alberta, among other things, lifted the statutory stay of proceedings so that the Bre-X Class Action could proceed forward through documentary and oral discoveries.

2. The Bresea Settlement under which Bresea paid $9 million closed on February 4, 2005.

3. Because John Felderhof was being prosecuted by the OSC in relation to his involvement with Bre-X, the decision was made to delay discoveries in the Bre-X Class Action until the evidence in the OSC hearing was completed and its production could be obtained in the Bre-X Class Action. On July 31, 2007, Justice Hryn found John Felderhof not guilty on all counts. The reasons can be reviewed here.

4. On March 26, 2007, Mr. Justice Winkler ordered that the examinations for discovery of John Felderhof in the Bre-X Class Action be held in Toronto and that the stay in the companion action against Ingrid Felderhof and Spartacus Corp. be lifted.

5. The plaintiffs have received the OSC exhibits produced at the Felderhof trial and are scheduling examinations for discovery in the class action. The plaintiffs intend to move to have companion action against Ingrid Felderhof and Spartacus Corp. certified as a class action.
